Terms of Service - Pet Note

In short: everything in Pet Note is free to use, except Care+, a small optional subscription that unlocks extra health features and helps support the app. Be honest with your account, be respectful of others, and remember that Pet Note (including Care+) is an organisational tool, not a vet, always ask a real veterinarian about your pet's health. You own your content; we just host it so the app works. You can delete your account at any time, and either of us can end this relationship if it's not working out.

1. Acceptance of these terms

These Terms of Service ("Terms") are an agreement between you and Wondertree Studios Pty Ltd (ACN 699 886 498, ABN 82 699 886 498, registered office Level 10, 387 George Street, Sydney NSW 2000, Australia), referred to here as "Pet Note", "we", "us" or "our", governing your access to and use of the Pet Note mobile app, this website, and any related services (together, the "Service").

By downloading, installing, creating an account, or otherwise using Pet Note, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you don't agree, please don't use the Service.

2. Who can use Pet Note

You must be able to form a legally binding agreement to use Pet Note. Pet Note is not directed to, and must not be used by, children under 13. If you're under 18, you should only use Pet Note with the involvement of a parent or legal guardian, who is responsible for the account and its use.

3. What Pet Note is

Pet Note is a companion app for dogs and cats that helps you keep every routine, reminder and milestone beautifully in sync, quick daily notes, a full timeline, smart local reminders, and a vet-ready pet passport for each of your pets.

Pet Note is free to download and use on iOS and Android, available via the App Store and Google Play. There are no ads, and everything in the app is free to use, with one exception: Care+, a small optional subscription that unlocks a health dashboard and AI-generated care summaries, and helps support the app's ongoing development. Care+ is purchased through the App Store or Google Play, and priced and billed by whichever store you subscribe through, we never see or store your payment card details. You can see the current price and what's included in the app before you're asked to pay anything.

4. Your account and keeping it secure

To use Pet Note you need an account. There are no Pet Note passwords, you sign in with Sign in with Apple, Google sign-in, or a passwordless email magic link. Because of this, keeping your account secure mostly means keeping your Apple ID, Google account or email inbox secure.

You agree to provide accurate account information and to keep it up to date. You're responsible for activity that happens through your account, and you should contact us at [email protected] immediately if you believe your account has been accessed without your permission.

5. Acceptable use

You agree not to:

use Pet Note for any unlawful, fraudulent, abusive or harmful purpose;
upload content that infringes someone else's intellectual property or other rights;
submit false, defamatory, harassing, hateful or otherwise unlawful content;
attempt to access another user's account or data, or any part of the Service you're not authorised to access;
reverse engineer, scrape, or interfere with the operation or security of the Service; or
upload malware or otherwise attempt to disrupt the Service for other users.

We may suspend or terminate access for accounts that break these rules, as described in section 10.

6. Your content

When you use Pet Note, you create and upload information about yourself and your pets, profiles, timeline entries, notes, reminders, and photos and receipt images ("Your Content"). Your Content is yours. We don't claim ownership of it.

To let us actually run the Service, store your data, sync it across your sessions, generate the short-lived signed links used to display your photos, and back it up, you grant us a limited, non-exclusive, worldwide licence to host, store, process, transmit and display Your Content solely for the purpose of operating, maintaining and providing Pet Note to you. This licence ends when you delete the relevant content or your account, subject to the brief backup retention described in our Privacy Policy.

We don't use Your Content for advertising, and we won't use identifiable photos, notes or records publicly (for example, in marketing) without asking you first.

You're responsible for the accuracy and legality of what you enter into Pet Note, including anything about other people (such as a co-owner or vet) that you include. We don't verify the records you enter, and we recommend keeping independent copies of anything genuinely important, such as vaccination certificates or insurance documents, outside the app as well, since Pet Note does not currently offer a data export feature.

7. Care+ and no veterinary advice

Pet Note offers an optional paid feature called Care+, which surfaces wellness scores and insights based on what you log for your pet. Any such score, insight, trend or summary, whether from Care+ or elsewhere in the app, is an organisational tool built only from the information you've entered. It is not veterinary advice, a diagnosis, or a medical device, and it can only ever be as complete as your own logging.

Always consult a licensed veterinarian for questions about your pet's health, and if your pet is showing signs of illness, injury or distress, contact a vet or emergency animal hospital immediately, don't wait on anything shown in Pet Note. See our Care & Data Safety page for more detail.

8. Reminders and notifications

Reminders you create are scheduled and delivered as local notifications on your own device, they are a convenience feature, not a guaranteed alert system. Delivery can be affected by things outside our control, such as your device's notification settings, battery optimisation, operating system behaviour, or the app being uninstalled or a device being replaced. Please don't rely on Pet Note as your only reminder for anything urgent or time-critical.

9. Availability and changes to the Service

We may update, change, add to or remove features of Pet Note over time, and we may occasionally need to suspend the Service for maintenance or due to circumstances outside our control. We'll try to keep disruption to a minimum and give reasonable notice of any material changes where we can.

10. Ending your use of Pet Note

You can stop using Pet Note and delete your account at any time, see Delete your account for how. We may suspend or terminate your access if we reasonably believe you've breached these Terms, created risk for other users or the Service, or where we're required to by law. Where practical, we'll try to give you notice first.

If we ever need to discontinue Pet Note entirely, we'll aim to give reasonable advance notice so you have a chance to save anything important, subject to the export limitations noted in section 6.

11. Disclaimers

We work hard to keep Pet Note reliable, but to the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied. We don't guarantee that Pet Note will be uninterrupted, error-free, or free of loss, corruption or unavailability of data, though we take the security and backup measures described in our Privacy Policy to reduce that risk.

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted or modified. Where such a law applies and cannot be excluded, our liability is limited to the maximum extent that law allows.

12. Limitation of liability

To the maximum extent permitted by law, and subject to section 11 above, Pet Note and its owners, employees and contractors are not liable to you for any indirect, incidental, special or consequential loss, or for loss of data, profits or goodwill, arising from or relating to your use of the Service.

To the maximum extent permitted by law, our total liability to you arising out of or relating to the Service is limited to the total amount you've paid us in the 12 months before the claim arose, or AUD $100, whichever is greater.

13. Indemnity

To the extent permitted by law, you agree to indemnify Wondertree Studios Pty Ltd against claims, losses and expenses arising from Your Content, your misuse of the Service, or your breach of these Terms or of another person's rights.

14. App store terms

If you download Pet Note through the Apple App Store or Google Play, your use is also subject to that store's own terms and policies. For Apple users specifically: these Terms are between you and Wondertree Studios Pty Ltd, not Apple. Apple has no obligation to provide maintenance or support for Pet Note, and Wondertree Studios Pty Ltd, not Apple, is solely responsible for the app, its content, and any warranty or claims relating to it, to the extent required by law. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

15. Governing law

These Terms are governed by the laws of New South Wales, Australia, and the courts of New South Wales have non-exclusive jurisdiction over any dispute arising from them, without limiting any rights you may have under consumer protection laws that apply regardless of this clause.

16. Changes to these Terms

We may update these Terms from time to time, for example as Pet Note's features change. If we make a material change, we'll update the "last updated" date at the top of this page and, where appropriate, let you know in the app. Continuing to use Pet Note after an update means you accept the revised Terms; if you don't agree, please stop using the Service and delete your account.
